5 17-05-2023 Heard Mr. Ritesh Kumar Narain Singh, learned counsel appearing on behalf of the petitioner and Mr. Arun Kumar Singh, learned A.P.P. for the State.

The petitioner seeks bail, who is in custody since 28.02.2019, in connection with Dariyapur P.S. Case No. 230 of 2018, dated 23.07.2018, registered under Sections 396 of the Indian Penal Code and 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that the petitioner has renewed his prayed for regular bail, who has been made accused under Section 396 of the Indian Penal Code read with Section 27 of the Arms Act.

Learned counsel fairly admits that the criminal antecedent of the petitioner is not fair, however, pairvikar and

his family member is ready to undertake not to allow the petitioner to fall in bad company.

Learned Additional District & Sessions Judge-12, Saran has also reported that trial is at the stage of framing of charge against the accused persons.

Considering the delay in progress of trial as well as the observation made by this Court vide order dated 16.11.2021, passed in Cr. Misc. No. 20942 of 2021 that if there is no substantial progress in the trial, the petitioner may renew the prayer for grant of bail, considering the fact that no substantial progress has taken in trial, the father of the petitioner must undertake to ensure that he will not allow the petitioner to fall in bad company and commit crime in future.

If the father of the petitioner files an affidavit to that extent, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Saran at chapra in connection with Dariyapur P.S. Case No. 230 of 2018, subject to condition that the above named petitioner will appear before the concerned local Police Station for three months every day at 09:30 A.M. and the concerned S.H.O. will submit monthly report of the
