Heard learned counsel for the appellants and learned Special P.P. for the State.
The petitioner is apprehending his arrest in connection with C.R. Case No. 05/2022, registered for the offence punishable under Section 323 of the Indian Penal Code and Section 3(1)(r) and (S) of SC/ST Act pending in the Court of learned Special Judge, SC/ST Act, Samastipur.
After some arguments, learned counsel for the appellants seeks permission to withdraw this application.
Permission is granted.
Accordingly, the instant application is dismissed as
withdrawn.
However, if the appellants surrender before the learned Court below within a period of six weeks from today and seek
Patna High Court CR. APP (SJ) No.609 of 2023(3) dt.05-07-2023 2/2
regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order.
