3 17-05-2023 Heard learned counsel for the appellant and learned Special Public Prosecutor for the State.

This appeal is filed against the order dated 15.12.2022 passed by the learned Additional Sessions Judge-I-cum-P.O. Children Court, Begusarai in connection with Teghra P.S. Case No. 225 of 2021 for the offence under Sections 302, 120(B)/34 of the Indian Penal Code and Section 3(2)(v) of the SC/ST Act as well as Section 27 of the Arms Act.

Submission of learned counsel for the appellant is that

similarly situated co-accused Chikku Kumar @ Shivam Kumar has already been allowed bail by a Co-ordinate Bench of this Court vide order dated 13.10.2022 passed in Cr. Appeal (SJ) No. 4738 of 2021, as contained in Annexure-3 to the memo of appeal.

In view of the above facts and circumstances of the case, the order dated 15.12.2022 passed by the Additional Sessions Judge-I-cum-P.O., Children Court, Begusarai is set aside and the present appeal is allowed. The appellant, above named, is directed to be enlarge on bail in connection with Teghra P.S. Case No. 225 of 2021 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional sessions Judge-I-cum-P.O. Children Court, Begusarai, subject to following conditions:-

(i) One of the bailors shall be either father or mother or sister or brother or wife or the person who has sworn the affidavit in bail application.

(ii) Appellant will co-operate in trial and will remain present on all dates and absence for two consecutive dates without appropriate permission would be a ground for cancellation of bail by the learned Trial Court itself.

(iii) If the appellant tampers with the evidence or the

witnesses, in that case, the prosecution will be at liberty to move
