submitted that petitioners have purchased the Waqf property without permission of Waqf Board which is not permissible in the eye of law and are void ab initio . It is pleaded in the counter affidavit filed by the opposite party no. 2, ( Mut awalli of Sogra Waqf Estate), that despite the service of notice, no reply was filed by the petitioners in the eviction application and after compliance of service of notice and due to non-appearance of the petitioners in the case before the learned Tribunal, the learned Tribunal rightly proceeded for ex parte hearing. In reply to paragraph 8 of the the Civil Revision, it is stated that the Title Suit No. 43 of 1985 was with respect to some other relief than the portion of land of the petitioners, which were illegally occupied. It is further stated that against the judgment and decree passed in Title Suit No. 43 of 1985, an appeal has been filed which is pending before the District & Sessions Judge, Nalanda at Biharsharif.
