When the matter was called out, Mr. Sanjeet Kumar, learned counsel for the respondent/plaintiff appeared and submitted that Title Suit No. 199/2014 has been disposed and decreed in favour of respondent/plaintiff by judgment and decree dated 3rd of January 2019.
Accordingly, submission is that the present case has become infructuous.
In view of the aforesaid submission, Mr. Pramod Kumar Sinha, learned counsel for the petitioner seeks permission to withdraw this application as infructuous.
Accordingly, this application is dismissed as withdrawn being infructuous.
