The present writ petition has been filed seeking the

following reliefs:-

“i. It be declared that the ancient Water Reservior/Ahar/Pyne bearing Khata No. 71, Plot No. 378 situated in village-Birampur, Police Station-Harnuat, District-Nalanda is the only source of fulfilling water-necessity of man, animals, birds and others on the one hand and on the other hand is the only source of irrigation of

about 400 Acres of agricultural land.

ii. An appropriate writ or direction be issued to the respondents directing and commanding them to forthwith stop construction work of Road etc., on the aforesaid ancient Water Reservoir/Ahar/Pyne situated at village-Birampur, Block-Harnaut, District-Nalanda.

iii. To direct the bureaucrats-respondent to produce up-to-date details as to what actions they had taken and how much money they have invested over safeguarding the aforesaid Ahar/Pyne under SATHI YOJNA under its functionary KRISHI KAMAND KSHETRA’ “JAL PRABANDHAN (SINCHAI)” UNDER KRISHI ROAD MAP SCHEME, MAHATMA GANDHI NATIONAL RURAL EMPLOYMENTS GUARANTEE ACT, 2005 etc.

iv. The bureauctrat’s respondents be further commanded and directed that without adopting any delaying tactics in relation to the Ahar-Pyne in question, take prompt action forthwith under the aforesaid legally launched schemes relating to safeguard the Ahar-Pyne.

v. Instantly remove all the blockage/hindrances of water flow of aforesaid ancient Water Reservoir/Ahar/Pyne created in league with the local officials particularly where it flows North to South touching the entire western part and dividing residential and agricultural land of village-

vi. To direct the respondents to keep vigilant eyes continuously in future so that continuous flow of water in the aforesaid water reservoir bearing Khata No. 71, Plot No. 378 situated at villageBirampur, Police Station-Harnaut, DistrictNalanda, shall not be disturbed and/or blocked by any one whosoever he may be.”

At the outset, the learned counsel for the petitioner

seeks liberty on behalf of the petitioner to approach the Circle Officer, Harnaut, District-Nalanda for redressal of his aforesaid grievances.
