The petitioner has preferred this application for grant of regular bail in a case registered under section 379 and other sections of the Indian Penal Code.
As per the prosecution case, it is stated that over a dispute relating to harvesting of the crops, Bachhwara P.S. Case no. 84 of 2021 was registered wherein the Officer-in-Charge had directed the Amin to submit a report. Thereafter, the SHO, Bachhwara ordered the informant to harvest the crops on some portion of the land. On the informant reaching the agricultural land it is stated that the nine named accused persons including the petitioner herein came variously armed. The petitioner made a demand of Rs. 25,000/- by way of rangdari. Co-accused Kamakhya Singh took away Rs. 3500/- from the pocket of the informant. The informant states that he remained silent and thereafter left the place of occurrence.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No such occurrence as alleged in the FIR has taken place. It is as a result of dispute relating to immovable property that the informant are lodging cases one after the other. The dispute is primarily civil in nature. The petitioner is in custody since 14.9.2021 and charge sheet has been submitted in the case.
Heard learned A.P.P for the State.
Having heard learned counsel for the parties and taking into consideration the allegation in the FIR, no injury having been caused to any person on the informant's side together with the petitioner having remained in custody for more than 7 months and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Bachhwara P.S. Case no. 108 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai.
