2 13-04-2022 Heard learned counsel for the parties.

The petitioner is in judicial custody in connection with

Raniganj P.S. Case No. 33 of 2020 registered under Sections 379, 511, 413 and 414 of the Indian Penal Code.

Allegation against him is that he was trying to open the shutter of a shop and when informant raised alarm he tried to escape. The people nearby caught hold of him and he gave his name as Md. Laltu @ Kurban, petitioner herein. A motorcycle was also seized in which no chasis number was inscribed. The same was also seized. It was in this circumstances that the petitioner came into judicial custody. As reflects from paragraph-3 of the bail application, he has six criminal cases under his belt.

Learned counsel for the petitioner submits that he has already suffered, is in jail since 19^th of January, 2020 (as stated in paragraph-13 of the bail application). He is ready to abide by any terms and conditions imposed while he releasing him on bail.

Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of like amount each to the satisfaction of ACJM,-VI, Araria in connection with Raniganj P.S. Case No. 33 of 2020, subject to the following conditions :-

(i) one of the bailor should be the family member of the petitioner, who shall provide official document to show his/her bona fide;

¶20

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reasons will entail his cancellation of bail by the Trial Court itself;

¶21

(iii) he shall appear before the concerned police station every fortnight for next six months to mark his presence;

¶22

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall take steps for cancellation of his bail bonds.

With the aforesaid observations, the bail application is allowed.
