The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 147, 148 and 149 of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, the petitioner is said to have caused firearm injury in the abdomen of the victim.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 5.4.2019 (Annexure-1) passed in Cr. Misc. no. 49396 of 2016. Inspite of the petitioner having remained in custody since 15.2.2016 ie for more than 6 years, the trial is still continuing and there is no chance of the same concluding in the near future.

A report was called for from the learned trial court. As per the report received contained in letter dated 21.3.2022 the prosecution evidence was closed and the statement of the accused under section 313 of the Cr.P.C. was recorded on 15.3.2022. The case is fixed for defence witness on 25.3.2022.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner together with the stage of the trial as per the report received from the learned trial court, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.

The learned trial court is directed to conclude the trial within a period of three months from the date of closure of the defence witness.
