2 28-09-2022 Heard the learned counsel for the parties.

This is an application seeking modification of

the order dated 26.07.2021 passed in Cr. Misc. No. 194

of 2021, whereby the application of the petitioners for

grant of anticipatory bail was allowed and they were

directed to be released on bail, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of the order, on their furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Masaurhi in connection with Masaurhi P.S. Case No. 365 of 2020, subject to the conditions as laid down under Section 438 (2) Cr.P.C.

It has been submitted on behalf of the petitioners that because of some unavoidable circumstances, they could not surrender before the Court below within the stipulated period.

For the reasons stated in the application, the prayer is allowed.

The order dated 26.07.2021 is modified to the extent that if the petitioner Nos. 1 and 2, namely, Chandan Kumar Thakur @ Poli Thakur and Guddu

Thakur respectively surrender before the Court below within a period of six weeks from today, they shall be

released on anticipatory bail on the same terms and conditions as laid down in the order dated 26.07.2021.
