Shambhuganj P.S. Case No. 113 of 2022 registered for the offence under Sections 401, 379 and 411 of the I.P.C.

The accused/petitioner is named in the F.I.R. and is in custody since 13.07.2022.

The allegation against the petitioner is to have in possession of the stolen property, with further allegation to deal thereof habitually.

Learned counsel appearing on behalf of the petitioner submitted that no stolen motorcycle, as alleged was recovered from the possession of this petitioner, who is a man of clean antecedent. It is further submitted that the name of petitioner surfaced on the basis of self-confession, in furtherance of which no incriminating material recovered, which may connect the petitioner with present stolen motorcycle. It is also submitted that alleged stolen motorcycle was recovered from the possession of co-accused, namely, Fantus Yadav, who has already been granted bail by one of the learned Co-ordinate Bench of this Court through Cr. Misc. No. 36068 of 2022, vide order dated 20.09.2022. While concluding the argument, it has been submitted that investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.

Considering the facts and circumstances as mentioned

above, as alleged stolen motorcycle was not recovered from the possession of this petitioner coupled with the fact that chargesheet has been submitted, let the petitioner, above named, is directed to be released on bail in connection with Shambhuganj P.S. Case No. 113 of 2022 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M.- I Class, Banka/concerned Court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C.
