The petitioners have preferred this application for grant of regular bail in a case registered under sections 302, 328 and 120B of the Indian Penal Code.

As per the prosecution case, the petitioner and coaccused persons are alleged to have killed the informant’s son by administering poison under conspiracy while the deceased was at his sasural after inter caste marriage with Babita Devi.

Learned counsel for the petitioners has submitted that

the petitioners are innocent and have falsely been implicated in this case. Nothing has been recovered from the possession of the petitioners. The other co-accused has already been granted bail by this Court vide order dated 22.08.2022 passed in Criminal Misc No. 25019 of 2022. The petitioners are father-inlaw and mother-in-law of the deceased. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 20.01.2022.

Learned A.P.P. for the State has opposed the bail petition of the petitioners.

Considering the aforesaid facts and circumstances of the case as well as the period of detention, the petitioners abovenamed, are directed to be enlarged on bail on furnishing bailbond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, East Champaran at Motihari in connection with Phenhara P.S. Case No. 23 of 2018.
