The petitioners have preferred this application for grant of regular bail in a case registered under sections 366A and 341 read with 34 of the Indian Penal Code and 8 and 12 of the POCSO Act.

As per the prosecution case, the petitioners and the coaccused persons are alleged to have kidnapped the minor daughter of the informant for solemnizing her marriage with co-accused Sanoj

Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. The victim in her statement recorded under Section 161 and 164 of the Cr.P.C. has stated that she solemnized her marriage with coaccused Sanoj Ram. It is further submitted that as per the medical report after general, physical, dental and radiologist examination, the doctor has opined that the age of the victim is between 19 to 20 years. The victim is a major. The petitioners have clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 28.03.2022.

Learned A.P.P. for the State has opposed the bail petition of the petitioners.

Considering the aforesaid facts and circumstances of the case, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Bettiah, District-West Champaran, in connection with Bagaha Mahila P.S. Case No. 39 of 2020.
