The petitioner has preferred this application for grant of regular bail in a case registered under sections 498A, 420, 313, 323, and 504 read with 34 of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act.

As per the prosecution case, the petitioner was married to the informant in the year 2019. The petitioner and coaccused persons started demanding Rs. 5 lacs as dowry and due to non-fulfillment of the said demand of dowry, the informant

was tortured by the petitioner.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is the husband of the informant. No dowry was demanded by the petitioner. The petitioner is accused in one more criminal case as stated in para 3 of the bail petition. The petitioner is in custody since 13.11.2021.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner. Charge-sheet has already been submitted under Sections 498A and 420 of the Indian Penal Code and Sections 3 and 4 of Dowry Prohibition Act.

Considering the aforesaid facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below, West Champaran in connection with Bettiah (Mahila) P.S. Case No. 05 of 2021.
