The petitioners are apprehending their arrest in

a case registered for the offences punishable under

Sections 379, 411, 34 of the Indian Penal Code.

The prosecution case as per F.I.R is that the

informant being S.I., Pauthu police station has received

¶29

a secret information regarding illegal mining and transporting of sand by the tractor drivers. Accordingly, he proceeded and saw that sands were loaded on two tractors. On seeing the police party, the drivers of the tractors fled away. Accordingly, two tractors were seized.

It is submitted by learned counsel for the petitioners that petitioners are owner and driver of one of the seized tractors. A supplementary affidavit has been filed to the effect that petitioners have already deposited the fine amount of Rs. 15,215/-(Fifteen Thousands, Two Hundreds & Fifteen) through e-challan in connection with the seized tractor to the Mines and

Geology Department, District Mining Officer, Aurangabad. A photocopy of e-challan is annexed as Annexure-3 of the petition. A statement has been made in para 3 of the petition that petitioners have no criminal antecedents.
