The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) and 56(b) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
Allegation is of recovery of 270 litres of liquor from a Mahindra Bolero Pick-up which was kept in cartons.
Learned counsel for the petitioner submits that the petitioner is in custody since 03.02.2022, prosecution report has been submitted and is a person with clean antecedent. Learned counsel further submits that petitioner was arrested from the Pick-up being the driver and, being the driver, the petitioner was

not aware what was kept in the Pick-up by the owner.
Learned A.P.P. for the State vehemently opposes the
prayer for regular bail of the petitioner.
Considering the fact that the petitioner is in custody since 03.02.2022, prosecution report has been submitted and is a person with clean antecedent, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Excise Case No. 58 of 2022.
