Heard learned counsel for the petitioner and Mr. Bharat Bhushan, learned APP for the State.

The petitioner is in custody in connection with Delha P.S. Case No. 285 of 2021 (N.D.P.S. Case No. 81 of 2021) under sections 8/20/b/ii/A/25 of the Narcotic Drugs & Psychotropic Substances Act.

Taking into account the recovery/seizure of 800 grm. of Ganja, charge-sheet stands submitted and the petitioner is in custody since 19.11.2021 as would reflect from the order of the learned Sessions Judge, this Court is inclined to grant him the privilege of bail.

Let the petitioner be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of like amount each to the satisfaction of learned

Additional District & Sessions Judge-II cum Special Judge, NDPS Act, Gaya, in connection with Delha P.S. Case No. 285 of 2021 (N.D.P.S. Case No. 81 of 2021) subject to the following conditions:

(i) one of the bailors should be the family members of the petitioner, who shall provide official document to show his/her bona fide;

¶21

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reasons will entail his cancellation of bail by the Trial Court itself;

(iii) he shall appear before the concerned police station every fortnight for next six months to mark his presence;

¶23

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds.

With the aforesaid observations, the bail application is

allowed.
