2 13-08-2021 Heard Mr. Rahul Maurya, learned counsel for the petitioner and Mr. Naresh Dixit, learned counsel appearing for the Respondent, i.e., IIT, Patna.
Petitioner has challenged the order dated 20th July, 2020 (Annexure-P/1) by which the name of the petitioner has been struck off from the roll of PhD programme on the ground that petitioner failed twice in the comprehensive examination.
Learned counsel for the petitioner submits that an
appeal has been preferred by the petitioner before Respondent

No.2, the Director, IIT, Patna at Annexure P-10 which is pending. Learned counsel further submits that in the interest of justice, the concerned authority may be directed to dispose of the appeal as per rules and regulation within a period of fifteen days.
Learned counsel appearing for IIT, Patna submits that one month’s time may be granted for disposal of the appeal.
Having heard learned counsel for the parties and taking into consideration the fact that petitioner has already preferred an appeal before Respondent No.2, this writ application is disposed with a direction to Respondent No.2, The Chairman, Senate (The Director)IIT, Patna to decide the appeal filed by the petitioner at Annexure- P-10 in accordance with law by a speaking and reasoned order within a period of one month from the date of production/receipt of this order.
With the aforesaid observation and direction, the instant writ petition is disposed of.
