2 02-03-2021 The present writ petition has been filed seeking a direction upon the respondent authorities to release the truck of the petitioner which has been seized in connection with Patepur P.S. Case No. 9 of 2020 under Section 7 of the Essential Commodities Act.
The learned counsel for the petitioner submits that no confiscation proceeding has been initiated till date, hence he would be approaching the learned court of ACJM-XIV, Vaishali at Hajipur for release of the truck in question.
The learned counsel for the respondent Shri Alok Ranjan has got no objection.

Accordingly, the present writ petition stands disposed off with liberty to the petitioner to approach the learned court of ACJM-XIV, Vaishali at Hajipur in connection with Patepur P.S. Case No. 9 of 2020 for release of the truck in question and in case such an application is filed under Section 451 Cr.P.C., within a period of four weeks from today, the learned court below shall consider the same and pass appropriate orders within a period of four weeks thereafter.
