2 10-12-2021 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioner and learned APP for the State through video conferencing.

The petitioner apprehends his arrest for the offences alleged under Sections 147, 149, 341, 323, 353 and 504 of the Indian Penal Code, registered in connection with Kotwali P.S.Case No.152 of 2020.

Allegedly, the petitioner, who was a tempo driver, was deloading the articles from his tempo, due to which there was a road jam. When the informant asked him to clear the jam by displacing his tempo, the petitioner abused and assaulted him and when a constable came to rescue, the petitioner also misbehaved and manhandled him.

Learned counsel for the petitioner has submitted that

the allegation against the petitioner is false. He is not the driver of that tempo and he was not arrested at the spot. The FIR shows that when the police inquired from the shopkeepers of the locality, they apprised the name of the petitioner to the police party.

Considering the nature of the allegation, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhagalpur in connection with Kotwali P.S.Case No.152 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
