Heard learned counsel for the petitioner and the State.
The petitioner seeks regular bail in Khagaria (Gangour) Police Station Case No. 654 of 2019 (Tr No.13/2020) registered for the offences punishable under sections 302/34 of the IPC and 27 of the Arms Act.
Earlier prayer for bail of the petitioner was refused by this Court vide order dated 5.2.2020, passed in Cr.Misc.No. 6639/2020. From the report of the court below dated 14.5.2021 it appears that out of seven prosecution witnesses three witnesses have already been examined and the case is pending for examination of remaining prosecution witnesses.
Considering the nature of allegation and the progress of the trial, prayer for bail of the petitioner is refused.
As the petitioner is in custody since 23.8.2019, trial
