In view of the agreed submissions at the Bar, this writ application is being disposed of granting liberty to the petitioner to file an appropriate application in the court below for release of the seized rice and wheat if no confiscation proceeding has been initiated so far.

Learned counsel for the State has submitted before this Court that in case a confiscation proceeding is found to be already initiated, it is open for the petitioner to approach the concerned District Magistrate-cum-Collector who is the confiscating authority for an appropriate order.

This Court, accordingly, grants liberty to the petitioner to make his application before the either forum as the

case may be available to him. In case such an application is preferred by the petitioner, the same will be considered expeditiously and will be disposed of by the concerned court/authority as the case may be within a period of 30 days from the date of filing the said application.
