Heard learned counsel for the petitioner and

By way of the present application, the petitioner

has sought for pre-arrest bail in connection with Sidhawalia P.S. Case No.104 of 2019 registered for the offences punishable under Sections 341, 323, 307 and 379 read with 34 of the Indian Penal Code.

Considering the admitted fact that the informant

and petitioner are agnates and one Loha Singh had filed Complaint Case No.1217 of 2019 dated 28.05.2019 before the learned A.C.J.M. Gopalganj against the informant in which the petitioner is witness no.2 and the court below has recorded that the prosecution failed to bring the injury report on record in spite of the opportunity having given to it, the prayer for grant of pre-arrest bail is allowed. released on bail in the event of arrest or surrender in the court below on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj in connection with Sidhawalia P.S. Case No.104 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
