The petitioner is apprehending his arrest in a case

registered for the offences punishable under Sections 379,382/34 of the Indian Penal Code.

Two unknown person on Apache TVS motorcycle bearing registration No.BR07V 3033 allegedly snatched chain of the informant, a lady, who was going on foot. The said motorcycle was recovered from the house of the petitioner.

Learned counsel for the petitioner has drawn attention of the Court to the further statement of the informant before the police wherein she stated that after snatching her chain, when the miscreants started fleeing, some person available there

chased them and they noticed the Registration No. of the motorcycle and came back and informed the Registration No. The petitioner has got a criminal case registered under Sections 143,341,384,385,386,379,354,323,504,506 of the Indian Penal Code. In para-16 of the bail petition, petitioner has stated that the said matter has already been compromised.

Learned counsel for the petitioner submits that only on suspicion, the motorcycle of the petitioner was seized. Moreover, the house is occupied by other family members also. Petitioner is young and prospering student.

Considering the nature of allegation and nature of material available, I am not inclined to enlarge the petitioner on anticipatory bail in connection with Town P.S.Case No.101 of 2019 pending in the court of learned Chief Judicial Magistrate, Darbhanga. Hence, prayer is refused.

In the event of surrender of the petitioner within thirty days, prayer for regular bail shall be considered without being prejudiced by this order.
