Heard learned counsel for the petitioner and learned counsel for the State via video conferencing.

Nobody appears for the opposite party no.2

It would appear from the record that while issuing notice to the opposite party no.2 on 26.03.2019, the provisional pre-arrest bail was granted to the petitioner. It would further appear that on 15.07.2019, both the parties appeared before the Court and agreed to settle the dispute amicably before the Mediation and Conciliation Center. Accordingly, the matter was referred to the Patna High Court Mediation and Conciliation Center.

In the interim report dated 26.09.2019, the learned Mediator stated that both the parties are willing to restore the

conjugal life and in this regard they want to go together again for two weeks, and after two weeks, they would again appear in the mediation proceeding. Thereafter, the learned Mediator submitted a final report dated 13.11.2019 stating therein that the mediation failed.

It is submitted by the learned counsel for the petitioner that there is no truth behind the allegation of subjecting the opposite party no.2 to cruelty for non-fulfilment of demand of dowry. It is further submitted that the complainant has filed the instant case only because of matrimonial discord and incompatibility.

Learned counsel for the State has opposed the application for grant of pre-arrest bail to the petitioner.

Regard being had to the nature of the allegation, the pleadings made in the application and the submissions advanced at the Bar, the provisional bail granted to the petitioner vide order dated 26.03.2019 is, hereby, confirmed.
