Heard learned counsel for the petitioner and learned

APP for the State through virtual court proceeding.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 272/273/34 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner that there is no recovery from the conscious possession of the petitioner. There is recovery of total 200 liters of country made illegal wine behind the house of the petitioner. The petitioner has got no criminal antecedent.

Learned APP for the State opposes the bail petition.

Petitioner is agreed to deposit a sum of Rs. 25,000/(Rupees Twentyfive Thousand) in the Chief Minister Relief

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II cum Special Judge, Excise Act, Gopalganj in connection with Baikunthpur P. S. Case No. 325 of 2019.

The bail bond of the petitioner shall be accepted by the learned Court below on showing receipt of deposit of Rs. 25,000/- (Rupees Twentyfive Thousand) in the Chief Minister Relief Fund.
