The petitioner is languishing in custody for the offences punishable under Sections 406/420/467/468 of the Indian Penal Code.

Allegation against the petitioner is that he was an employee of the informant’s company. The petitioner collected loan amount from different loanees on 12.10.2018 and did not deposit the same with the company, rather misappropriated the same. The loanees have supported the allegation that they had paid the installment amount to the petitioner. One of the loanees also paid money to the petitioner as he had ensured for getting sanction of one lac more in favour of the loanee. The past history of the petitioner while he was working with other company is that identical three cases were lodged against the petitioner. Petitioner

is in custody since 28.10.2018.

Earlier prayer for bail was refused on 19.06.2019 in Cr. Misc. No.835 of 2019 with liberty to renew the prayer if the trial is not concluded within six months from the date of receipt of a copy of this order.

Submission is that the trial is still pending and there is no chance of conclusion of trial in near future due to Covid-19 effect.

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/(Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Salaiya P.S. Case No.56 of 2018, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
