Heard the learned counsel for the petitioner and the learned APP for the State.

The petitioner seeks regular bail in connection with Desari P.S. Case No. 282 of 2019 for the offence punishable under Sections 414, 379/34 of the Indian Penal Code.

been intercepted and apprehended by the police and though upon search, no incriminating articles were found, however, they could not produce the registration paper of the motorcycle. The petitioner is stated to be the pillion rider.

The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case and till the time he was made accused in the present case, he had a clean antecedent as well as he is languishing in custody since

Having regard to the facts and circumstances of the case, considering the submissions advanced by the learned counsel for the petitioner, coupled with the fact that the petitioner was a pillion rider as also taking into account the period of incarceration, I deem it fit and proper to direct for release of the petitioner on regular bail.

Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Vaishali at Hajipur in connection with Desari P.S. Case No. 282 of 2019.
