Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 302/34 of the Indian Penal Code.

The prosecution case in brief is that the informant received information that in course of returning from K. Asthan, his father was shot dead. it was informed to the informant. On that informant, when he went near the cemetery, he found his father lying dead with pool of blood.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of

tampering of witnesses alleged against the petitioner. The petitioner is in custody since 07-12-2019. Charge sheet has already been submitted. The petitioner is not named in the FIR. His name transpired in this case on the basis of confessional statement of coaccused Mohan Mukhiya. The said co-accused has been granted bail by coordinate bench of this court vide order dated 19-07-20189 passed in Cr. Misc. No. 42930 of 2018.

On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case and also the lockdown, the petitioner, above named, is directed to be released on bail on his personal bond to the satisfaction of Sri Kumar Sudhanshu, learned Judicial Magistrate-Ist Class, Biraul, Darbhanga in connection with Kusheshwar Asthan P.S. Case No. 231 of 2016.

Once the normalcy is restored, the petitioner shall furnish bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each within a period of four weeks to the satisfaction of the court concerned in connection with the aforesaid case.
