In this case, the appellant is seeking bail in connection with SC ST GR No.187/2018, arising out of Darbhanga SC ST P.S. Case No.75 of 2018 registered for offence punishable under sections 341, 504, 354-A, 509, 506 of the Indian Penal Code and sections 3 (1) (r), 3 (s) of the SC/ST (POA) Act.

The appellant is father-in-law of Md. Tabarak.

The learned counsel for the appellant submits that there is no specific allegation against the appellant and he is in custody since 20.11.2019.

Looking to the entire facts and circumstances of the case, the appellant, named above, is directed to be released on bail on furnishing his personal bond to the satisfaction of 1^st

Additional Sessions Judge-cum-Special Judge SC/ST Act, Darbhanga in connection with SC ST GR No.187/2018, arising out of Darbhanga SC ST P.S. Case No.75 of 2018, subject to the condition that the appellant shall fully cooperate with the investigation/trial of the case, failing which, the court below shall be at liberty to cancel the bail bonds of the appellant.

Accordingly, the impugned order dated 1^st Additional Sessions Judge-cum-Special Judge SC/ST Act, Darbhanga in connection with SC ST GR No.187/2018, arising out of Darbhanga SC ST P.S. Case No.75 of 2018 is set aside and the appeal is allowed.
