Heard learned counsel appearing for the appellant as well as learned Special Public Prosecutor for the State through video conferencing.

This appeal has been preferred against the order dated 13.11.2019 passed in Special (POCSO) Case No.57 of 2019 by the learned 1^st Additional Sessions Judge-cum-Special Judge, Araria by which and whereunder the bail prayer of the appellant was rejected.

However, it is informed that the appellant is in jail custody since 12.09.2019 on the allegation that he as well as his associate snatched scarf of a minor girl and assaulted the informant and others.

Considering the facts and circumstances of the case as

well as period of detention of the appellant in jail custody, this appeal is allowed and the order dated 13.11.2019 passed in Special (POCSO) Case No.57 of 2019 by the learned 1^st Additional Sessions Judge-cum-Special Judge, Araria is hereby set aside. Accordingly, appellant is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1^st Additional Sessions Judge-cum-Special Judge, Araria in connection with Special (POCSO) Case No.57 of 2019 arising out of Narpatganj (Ghurna) P. S. Case No.535 of 2019.
