Sub Judge II, Danapur to dismiss the T.S. No. 54/2008 on ground of non-prosecution due to unauthorised, false and fraudulent filing of attendance (Hazari) by Sri Prabhunath Singh, the Advocate for private respondents without any Vakalatnama executed in his favour by his clients (the private respondents) regularly and continuously for four and half years from 02.08.2014 to 29.01.2019 and complete nonprosecution by total non-filing of attendance (Hazari) on 27.03.2019, 29.04.2019, 30.05.2019, 16.07.2019 and 19.08.2019 by any Advocate; (B) Your Lordships may be pleased to issue a further writ of mandamus commanding/directing the respondent no. 1, Registrar General, Patna High Court to issue direction to the Bar Council of Bihar to cancel the enrolment/registration to practice law of Prabhunath Singh, the Advocate without Vakalatnama of private respondents who has committed professional misconduct under the Advocates’ Act through filing of unauthorised, false and fraudulent attendance (Hazari) on behalf of his clients the private respondents regularly and continuously for four and a half years w.e.f. 02.08.2014 to 29.01.2019 and illegally showing them as present before the Court of Sub Judge II, Danapur, thus committing perjury and fraud in judicial records of the Court in dispersing violation of law and playing with the dignity of the Court.
