Heard learned counsel for the petitioner and learned counsel for the respondents.

2.The present writ petition has been filed for a direction to the “the respondent authorities to conclude the trial of Khagaul P.S. Case No. 11/2003 registered for the offences under Section 363, 498A, 323, 304B, 120B, 406, 201 of the Indian Penal Code in connection with Sessions Trial No. 1022/2006 which is pending in the Court of learned Additional District and Sessions Judge-I, Danapur, Patna.”

Learned counsel for the petitioner submits that protracted trail has been going on since the FIR was instituted in the year 2003 and the matter is lingering on.

Learned counsel for the Registrar, Civil Court, Patna (Respondent No. 6) and the Sub Registrar, Civil Court, Danapur (Respondent No. 7) appears and states that the trial has been progressing and the evidence of both sides have been closed. The matter is now at the stage of recording of statement of the accused under Section 313 Cr. P.C. It is submitted that the trial is expected to be concluded within a period of four months.

Having heard the parties and considering the nature of the grievance of the petitioner, the writ petition is disposed of with the observation that the learned trial Court shall expedite the trial and conclude the same expeditiously and preferably within a period of four months from the date of receipt/production of a copy of this judgement.
