No one appears for the petitioner. Counsel for the Food Corporation is present and submits that the present issue is no longer res integra.

After examining the records of this Court, this Court is of the view that the identical issue was raised in C.W.J.C. No. 1330 of 2018 for recovery of excess amount paid to the petitioners. In the aforesaid case, large number of petitioners approached this Court against the decision of recovery of excess amount paid and, after consideration of the fact and law, this Court in Single Bench has declared the action of the F.C.I. to be illegal and injuncted to recover the excess amount paid to the workers and that view has

been affirmed in LPA and S.L.P. and final seal has been given by the Hon’ble Apex Court.

In that view of the matter, the present case is also covered by the judgment passed in C.W.J.C. No. 1330 of 2018.

In view of the authoritative pronouncement, the F.C.I. is injuncted to recover the excess amount paid to the petitioners. It is also made clear that if the excess amount has already been recovered from the petitioners, that should be returned to them along with 6% simple interest.

With the aforementioned observation and direction, this writ application is disposed of.
