2 15-07-2019 Heard learned counsel for the petitioner and the State.

As agreed at the Bar the writ application is being disposed off with a direction to the District Magistrate, Purnea (Respondent No. 3) to look into the grievance of the petitioner, consider the same and in case it is found that his candidature was required to be considered in view of the removal of the discrepancies in his application by him at least about two months before the recommendations were made by the Selection Committee, as being claimed the same be considered for purpose of grant of appropriate relief.

Let the petitioner will be at liberty to file an

application in terms of Clause 32(iii) of the Bihar Targeted P.D.S. (Control) Order, 2016. If no selection has been made for the given seat/vacancy till date, the issuance of license may be kept in abeyance till disposal of the appeal of the petitioner, provided it is so made within 15 days from today. In case selection has already been made and license has been issued to the selected candidate and respondent no. 3 proposes to pass an order adverse to the interest of the selected candidate, an opportunity of hearing shall also be given him.

Let the whole exercise be completed within a period of 60 days from the date of submission of the objection/appeal by the petitioner.
