3 11-07-2019 Petitioner has been compelled to move this Court in its writ jurisdiction when her statutory appeal being E.C. Appeal No.48 of 2016 has remained pending for about three years before the Collector, Banka (respondent no.2).
The statutory period for disposal of the appeal is sixty days and if it has remained pending for about three years, the grievance of the petitioner is genuine.
Learned counsel for the State submits that in the given circumstance a direction may be issued to the respondent no.2 to consider and dispose of the statutory appeal within a reasonable time.

In the given facts and circumstances of the case, this writ application is being disposed off with a direction to the District Magistrate-cum-Collector, Banka to consider and dispose off the statutory appeal being E.C. Appeal No.48 of 2016 within a period of 60 days from the date of receipt/production of a copy of this order, failing which the petitioner will have occasion to move an appropriate application before this Court.
