Petitioner is aggrieved by the selection procedure adopted by the District Level Selection Committee for grant of public distribution shop licence. It is the case of the petitioner that while the private respondents have been granted the licence, the candidature of the petitioner has been ignored by violating the norms and procedures which have been laid down for the purpose of consideration of the applications for grant of licence.

It is submitted that in this regard the petitioner has submitted his objection dated 04.09.2018 as contained in Annexure-7 to the writ application before the District Supply Officer, Madhepura, but the same has not been considered. It is further submitted that his

objection submitted before the District Magistrate vide Annexure-9 to the writ application has also not been able to draw the attention of the District Magistrate, Madhepura.

Learned counsel for the State submits that on perusal of Annexure-9 it is not clear that the representation/objection was submitted in the office of the District Magistrate, Madhepura, therefore the petitioner, if so advised, may file a fresh representation before the District Magistrate, Madhepura for consideration.

In the given facts and circumstances of the case and in the nature of the pleadings available on the record, this Court grants liberty to the petitioner to file a fresh representation/objection before the District Magistrate, Madhepura within a period of thirty days from today and in case such representation/objection is preferred before the District Magistrate, Madhepura, the same shall be considered and will be disposed off by a reasoned order after hearing all concerned and stake holders within a period of ninety days from the date of receipt/production of a copy of this order.
