appearing for the petitioner and Mr. Ashok Kumar Dubey, learned counsel appearing for the State.
This writ petition in public interest was filed objecting to the height of the road running between Hayaghat to Hathauri Kothi in the district of Darbhanga.
It is contesting the stand that a counter affidavit is filed and paragraph 6 whereof is sufficient explanation of the

apprehensions expressed by the petitioner. In fact the counter affidavit also encloses a report which inter alia indicates that except for a few houses which are finding some difficulty on the construction of the road, the level of the road is in tune with the flanks. It is also mentioned that by the side of the road drain outlets are being constructed so as to avoid any water logging.
In such view of the matter, we do not consider it proper that the matter needs any persuasion and the writ petition is accordingly disposed of.
