The present writ petition has been filed for quashing the order dated 13.12.2016 passed by the District Magistrate cum Collector, Samastipur in Arms Case No. 25 of 2016 whereby and whereunder the application of the petitioner for grant of arms licence has been rejected.

At the outset, the learned counsel for the petitioner seeks liberty to challenge the aforesaid order dated 13.12.2016 before the appellate authority by filing an appeal.

Accordingly, the present writ petition stands disposed

of with the aforesaid liberty, however, with a further direction that in case appropriate appeal is filed within a period of four weeks from today, the appellate authority shall examine the appeal of the petitioner on merits, without being impeded by the issue of limitation.

It is needless to state that the appellate authority shall make endeavour to dispose of the appeal, so filed by the petitioner, within a period of twelve weeks of filing of the said appeal.
