Learned counsel for the petitioner submits that the petitioner has been made accused in this case only on the basis of suspicion. He submits that nothing has been recovered from the possession of the petitioner. He further submits that in absence of ingredient of the offence of theft in the F.I.R., the case under Sections 413 and 414 of the I.P.C. is not sustainable. The petitioner is in custody since 27.10.2018 and he has got no criminal antecedent.
