out of Complaint Case No. 2259 of 2017, disclosing offences under Sections 498A/34 and 494 of the Indian Penal Code.

Petitioner happens to be husband of the complainant and allegation against him is of subjecting the complainant to cruelty and torture in connection with demand of dowry.

Submission of learned counsel for the petitioner is that out and out false and fabricated allegation has been levelled by the complainant, which will appear from the fact that the marriage between the petitioner and complainant was solemnized ten years ago and when they were not having any issue, the petitioner as per the consent of the complainant

remarried with another lady but after some time complainant got annoyed and lodged this false case.

It appears that in this case notice was issued to the complainant/opposite party no. 2 and on her behalf vakalatnama has also been filed but today nobody appears on behalf of the complainant.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Katihar, in connection with Complaint Case No. 2259 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
