Petitioner seeks bail in anticipation of his arrest in connection with Banka (Mahila) P.S. Case No. 52 of 2018 registered for the offences punishable under Sections 498A, 341, 323, 504 and 506 of the Indian Penal Code.

Allegation against the petitioner is of subjecting his wife to cruelty and harassment with respect to demand of a car.

Submission of learned counsel for the petitioner is that he is still ready to keep her with him with all dignities and care and for that the matter was sent to the Mediation Committee and before the Committee she did not agree to live with the petitioner.

Heard learned APP and learned counsel for the informant, who has opposed the prayer for anticipatory bail

stating that she is also ready to live with the petitioner.

In such view of the matter, the parties are directed to

appear before the learned court below on 8.3.2019 and petitioner will file an application that he is ready to keep the informant with him with all dignities and care and on such application learned court below shall allow both the parties to live together with an undertaking that he will keep her with all dignities and care and in that event petitioner shall be released on provisional bail for a period of six month and learned court below shall watch the conduct of the parties by calling them in first week of every month and if the court is satisfied with their conduct, the bail bond of the petitioner shall be confirmed by the court below itself, otherwise the court is free to pass any other order(s) as it may deem fit and proper, including cancellation of his bail bond.
