Heard learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks bail in Laukaha P. S. Case No. 70 of 2018 instituted for the offence under Section 393 of the Indian Penal Code.
Learned counsel for petitioner submits that petitioner was not apprehended on the spot.
As per written report one Birendra Yadav was apprehended on the spot and he disclosed the name of this petitioner. The looted motorcycle has been recovered from possession of co- accused Birendra Yadav. Learned counsel for petitioner submits that co- accused Birendra Yadav has already been granted regular bail by co-ordinate Bench of this Court by order dated 14.9.2018 passed in Cr. Misc. no. 50240 of 2018.

Considering the aforesaid, let the petitioner, above
named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Jhanjharpur, Dist. Madhubani, in connection with Laukaha P. S. Case No. 70 of 2018, corresponding to G.R. No. 319 of 2018 subject to the condition that both the bailors shall be the close relative of the petitioner.
