Learned counsel for petitioner submits that he has applied for grant of license for running his Saw Mills under Bihar Saw Mill (Regulation) Act, 1990 and was granted license no. 91 of 1996 vide memo no. 985 dated 9.7.1996 which is annexed as Annexure-1 to the writ petition. It has been submitted that subsequently the petitioner has submitted his application for renewal of the license for the year 1997 to 2011 before the respondent no.3 but the same has not yet been granted. Thus, the license is deemed to be renewed in terms of Rule 6 of Bihar Saw Mills (Regulation) Rules, 1993. The copy of the applications for renewal of the license for the year 1997 to 2011 has been annexed as Annexure- 2 series to the writ petition. Learned counsel further submits that recommendations were made by the CEC on 16.3.2011 that all the licensed Saw Mills are not to be closed down and pursuant thereto the Principal Chief Conservator of Forest, Bihar, Patna,. vide his Memo no. 2185 dated 9.9.2011 issued a direction to all the Divisional Forest Officers that the renewal must be done in terms of Rule 6 of Bihar Saw Mills (Regulation) Rules, 1993.
