Heard learned counsel for the petitioner and the

learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Lakhisarai (Kabaiya) P.S. Case no. 483 of 2019, registered under Section 30(a) and 32(III) of Bihar Prohibition and Excise Act, 2016.

The accusation is that on receiving secret information about carrying of liquor by Rajeev Kumar @ Bhutia (Petitioner) from Surya Narayan Ghat towards Kuil, the informant along with other Police personnel reached there then a person was seen coming from a damaged hut, but on seeing the Police party, he succeeded to flee away. On search of hut, 48 liters of country made liquor recovered.

Learned counsel for the petitioner submits that

petitioner was not apprehended on the spot nor the alleged damaged hut belongs to the petitioner. The petitioner is accused in similar nature of cases as detailed in paragraph No.3 of the petition, due to that reason he has falsely been implicated in this case mere on suspicion.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-IIcum-Special Excise, Lakhisarai in connection with lakhisarai (Kabaiya) P.S. Case No. 483 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
