Heard learned counsel for the petitioner and the learned APP for the State.

The petitioner apprehends his arrest in connection with Angarghat P.S. Case No. 46/202019 registered under Sections 147, 148, 149, 307, 323, 324, 325, 341, 379, 504, 506 of the Indian Penal Code.

The accusation is that in the morning of 29.5.2019 seven persons named in the FIR including the petitioner, pattidar of the informant came with deadly weapon. At that time Ram Bilas Ray gave katta blow upon the head of the informant, Rakesh Rai gave Danda blow and the petitioner assaulted him by means of iron rod at his hand leg and waist. Lakhan Rai started to press neck of son of the informant.

Learned counsel for the petitioner submits that

occurrence took place due to land dispute in which petitioner side's had also assaulted injury regarding which Angarghat P.S. Case No.46/2019 was instituted on the basis of fardbeyan of wife of the petitioner against the informant of the present case and his family members. Further submission is that only two lacerated injury were found one on frontal region and the opinion regarding same is kept reserve.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IInd, Dalsinghsarai, Samastipur, in connection with Angarghat P.S. Case No. 46/202019 subject to the condition as laid down under Section 438(2) of the Cr.P.C.
