The petitioner seeks bail in K. Hat P.S. Case No. 658 of 2018, instituted for the offence under Section(s) 302, 224/34 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged in the written report that the Juvenile in conflict with law kept in Observation Home, purnea, namely, Subham Kushwaha, Brajesh Singh, Ritesh Eklauta Gupta @ Kallu Kala, Karan Kumar @ Raja and Vikash Yadav shot fire on employees of the Observation Home, Vijendra Kumar (House Keeper) and Saroj Kumar. brought to Sadar Hospital, Purnea. The infornmant after getting information rushed to Observation Home and found the House Keepers and the Child in conflict with law in pool of blood.

Counsel for the petitioner submits that petitioner is not named in the written report. The Sessions Judge has mentioned in the impugned order that all the miscreants after committing offence fled away from Innova vehicle of this petitioner which was driven by Mithun Kumar. Counsel for the petitioner further submits that Mithun Kumar has already been granted bail by this Court vide order dated 5.2.2019 passed in Cr. Misc. 5219 of 2019.

Petitioner is in custody since 11.9.2018.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with K. Hat P.S. Case No. 658 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
