The petitioner seeks bail in a case registered under Sections 341, 323, 324, 307, 379, 354(B), 504, 506, 34 of the Indian Penal Code.
The prosecution case in short is that the accused persons variously armed came at the door of the informant and calling his mother Dayan, started abusing and on protest, the informant’s mother was assaulted, as a result of which, informant’s mother sustained injury.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 05-11-2018. Charge

sheet has already been submitted. There is case and counter case between the parties. The petitioner has been falsely implicated in the present case. There is allegation of single farsa blow causing injury to mother of the informant. Both parties are agnates. There is no allegation of repetition of farsa blow. The injury on the side of the accused has not been explained by the prosecution.
On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Madhubani (Town) P.S. Case No. 62 (CRI. Case No. 336 of 2018).
