Allegation against the petitioner is that he in collusion with other accused persons, withdrew Rs. 20000/- from the account of the informant and petitioner happens to be the waterman.
Submission of learned counsel for the petitioner is that petitioner has been made escape-goat and as a matter of fact coaccused Madan Kumar Vishwash who has withdrawn the amount and now he has deposited the amount also.
Heard learned APP as well as learned counsel appearing on behalf of the Central Bank of India, who has opposed the

prayer for anticipatory bail on the ground that process under Section 82 Cr.P.C. has already been issued against the petitioner.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to him rather he should surrender within a period of six weeks from the date of receipt of a copy of this order and make prayer for regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order.
