2 04-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Barauli P.S. Case No. 85 of 2019 registered for the offences punishable under Sections 341, 323, 307, 354, 379, 504 and 506/34 of the Indian Penal Code.

As per FIR petitioners and other accused persons attacked the house of the informant and assaulted her Dewar and there is specific allegation against co-accused Jitendra Mahto that he assaulted her Dewar and allegation against petitioner No.3 is that he tried to disrobe her.

Submission of learned counsel for the petitioners is that there is case and counter case between the parties and

allegation of disrobing the informant is ornamental in nature and there is no other allegation against the petitioners.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-XIV, Gopalganj, in connection with Barauli P.S. Case No. 85 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
